(United States Ninth Circuit) - In a copyright action,the district court's grant of summary judgment to defendants is affirmed and the court held that a party raising a first sale defense to copyright infringement bears an initial burden with respect to the defense which, once met, and shifts the burden back to the copyright owner to set up absence of a first sale.
