(United States Ninth Circuit) - Reversed the dismissal of an immigrant's Federal Tort Claims Act suit alleging he was wrongfully removed from the United States in violation of a temporary stay of removal. The federal government argued that the immigrant could not sue the government for damages attributable to his wrongful removal because an immigration statute deprived the court of jurisdiction over the Department of Homeland Security's execution of removal orders. Rejecting this argument, the Ninth Circuit held that the district court had subject matter jurisdiction over the immigrant's suit.
