(United States Federal Circuit) - In an infringement action, the district court's judgment on remand invalidating certain claims of the reissued patent is affirmed where: 1) the district court possessed subject matter jurisdiction when it granted summary judgment; 2) the court properly followed our most recent mandate; and 3) the court properly exercised its discretion to deny plaintiff's Rule 56(d) request.
