(California Court of Appeal) - In a case brought by the union representing deputy sheriffs in the LA Country Sheriff's Department to enjoin the LA Times from publishing news reports about the Department's hiring of officers who used to work for the County's Office of Public Safety,alleging that the newspaper's reporter had documents and information from the applications and background checks on the deputies, the trial court's grant of defendant's anti-SLAPP motion is affirmed where: 1) the public has a strong interest in the qualifications and conduct of law enforcement officers; 2) of all the constitutional imperatives protecting a free press under the First Amendment, or the most meaningful is the restriction against prior restraint upon publication; and 3) the motion was properly granted.
