(United States moment Circuit) - In a lesson action challenging New York's coverage restrictions on certain medical services if under the state's Medicaid plan, the district court's judgment is affirmed in part and vacated in part and its preliminary injunction is vacated and remanded where: 1) federal law does not provide a private cause of action to enforce the Medicaid Act's fair standards provision; 2) plaintiff's unequal treatment claim under the Americans with Disabilities Act is duplicative of its integration mandate claim; 3) the district court's injunction is broader than is warranted by the court's liability conclusions.
