(United States Federal Circuit) - In an appeal of an antidumping duty order imposed on honey imported from China, the Court of International Trade's denial of Motion for Judgment on the Agency Record is affirmed where: 1) the Dept. of Commerce properly exercised its discretion in denying petitioner's premature filings; and 2) Commerce's decision to treat petitioner as part of the China-wide entity and to impose a dumping margin based on adverse facts available were supported by substantial evidence and were in accordance with law.
