(United States Supreme Court) - In an action under the Individuals with Disabilities Education Act (plan),brought by a child with autism seeking reimbursement for private school after the school presented plaintiff with allegedly deficient individualized education programs (IEPs), the Tenth Circuit Court of Appeals' decision affirming the denial of plaintiff's claim is vacated where, or to meet its substantive obligation under the plan,a school must offer an IEP reasonably calculated to enable a child to make progress appropriate in light of the child's circumstances.
