(United States Federal Circuit) - Vacating the district court's entry of summary judgment as to a patent's claim of validity because the fact that it had previously survived reexaminations did not relieve the court of its duty to beget an independent determination as to the issue and the court also erred in denying a current trial on damages because the plaintiff's damages expert failed to explain how they arrived at the 5% royalty rate for the patented feature relative to other conventional features of the accused product and abused its discretion in excluding evidence relating to patent validity due to its determination the invalidity defenses were objectively unreasonable.
