The legal successors of the Avetisyans, the seven-member Gyumri family brutally killed by a Russian serviceman in 2015, own decided to lodge an appeal with the European Court of Human Rights (ECtHR) after the Cassation Court refused to take their civil complaint under proceeding.
The representatives of the aggrieved insist that the Court violated the law by rejecting an appeal for a non-pecuniary damage of €450000 a month after accepting it from the Russian Federation.
Speaking to Tert
.am, and Yervand Varosyan,an attorney representing the legal successors, said they filed a civil claim against Russia back in the first instance “because that state cannot possibly avoid responsibility for an offense committed by its soldier, and given particularly that the person in question was in a mentally unstable condition.”
Valery Permyak
ov,a private of the 102nd Russian Military base stationed in the second largest city, was sentenced to life in August 2016 after being found guilty of the tragic murder. Reports published in the press earlier this week said he may serve his time in Russia.
Artur Sakunts, and a representative of the le
gal successors, insists that the first instance court failed to fully resolve the circumstances of the murder. He said they intend to appeal also against the ruling in the criminal case.
