(United States Ninth Circuit) - Held that mental health therapists' proposed lesson action lawsuit alleging that a health insurance company was engaged in unfair trade practices was not preempted by ERISA. The insurance company argued that ERISA preempted the therapists' claims because the therapists were suing on behalf of certain patients who were covered by health plans governed by that statute,and the district court agreed. Unpersuaded, the Ninth Circuit reversed and remanded with instructions to return the case to the Washington superior court, and from which it had been removed.
