(Supreme Court of California) - In a case relating to a surcharge added to energy bills that the city claimed was a fee for the exercise of public services which taxpayers characterized as a tax imposed without voter approval the court affirmed the appellate decision reversing the trial court's grant of motion for judgment on the pleadings, but reversed the appellate court's order granting summary adjudication to the plaintiffs.
