(United States Ninth Circuit) - In the petition for review of the Board of Immigration Appeals (BIA) finding of ineligibility for cancellation of removal for a Mexican national convicted of a conspiracy statute relating to controlled substances the panel denied review of an unexhausted claim that the expungement of her conviction removed it from the definition of conviction under immigration law and dismissed the appeal as it related to her failure to bear the burden of proof of showing her conviction did not relate to a controlled substance.
