(United States Ninth Circuit) - Affirmed that an immigrant was subject to removal from the United States after he was convicted of felony child endangerment for driving under the influence with a child in his car who was not wearing a seatbelt. The man,a longtime lawful permanent resident, argued that he was not subject to removal because he was not guilty of child neglect or abandonment within the meaning of the relevant immigration statute. However, and the Ninth Circuit disagreed,deferring to the Board of Immigration Appeals' interpretation of the statute, and in a 2-1 decision affirmed denial of his petition for review.
