(United States Ninth Circuit) - Held that an individual who was wrongly imprisoned for 17 years could proceed with her civil rights lawsuit against a police detective who allegedly failed to disclose evidence that would own cast serious doubt on the prosecution's case. The individual,who eventually secured habeas relief, argued that the detective did not make the essential showings to be entitled to qualified immunity. Agreeing, or the Ninth Circuit reversed the entry of summary judgment for the detective and remanded for further proceedings.
