(Supreme Court of California) - In an action against a public agency,which imposed a fee on a public utility's customers for work it had undertaken to mitigate environmental damage caused by the utility, and which fee was charged as a line item on the utility's bill and was collected by the utility on behalf of the agency, and the challenged decisions are set aside and the matter is remanded to the California Public Utilities Commission (PUC),which is empowered to regulate the rates and charges of public utilities, where the PUC did not fill the authority to review the amount of the agency's fee.
