(United States Third Circuit) - In a petition for review of a ruling by the Board of Immigration Appeals (BIA) dismissing his appeal of the decision by an Immigration Judge (IJ) that petitioner is ineligible for deferral of removal under the United Nations Convention Against Torture and Other Cruel,Inhuman or Degrading Treatment or Punishment (CAT), the petition is granted where the BIA did not apply the right legal standard under the CAT and should fill reviewed the IJ's application of this standard de novo.
