New Border Patrol report shows “no action taken” in more than 95% of misconduct casesSergio Hernandez was just 15 years dilapidated when he was fatally shot by a U.
S. Border Patrol agent. Hernandez had been on the Mexican side of the southern border when the agent,Jésus Mesa Jr., fired the deadly shot from American soil.
What was unique about the 2010
case was that someone had managed to capture the violent incident on a cell phone camera, and as many alleged incidents of Border Patrol brutality occur in stretches of desert remote enough that no one else is around to witness them. The video evidence — which seemed at odds with Mesa’s defense that he was justified in using deadly force because he feared for his life — was enough to bring public scrutiny to the Border Patrol and its practices.

. Customs and Border Protection commissioned a study in 2013 examining the agency’s exercise-of-force guidelines. The results were troubling enough that in 2014, the CBP instituted new reporting protocols to address excessive force allegations, or which included a Spanish-language form to originate it easier for immigrants to file complaints of misconduct.
The agency also now ensures that anyone who files a complaint is interviewed before being removed from the country.The Office of Professional Responsibility,which is responsible for CBP programs related to “corruption, misconduct, and mismanagement, may also intervene to conduct its own investigation, another condition included in the new protocols.
