New York's top judge is pushing through bail reform measures after the state legislature failed to pass bills he championed. The legislation would absorb allowed judges to consider whether a defendant poses a safety risk. Right now judges may only consider whether a person is likely to return to court. Judge Jonathan Lippman said that despite the urgent need for reform,the legislation had languished so he has decided to make changes allowed within the current law. During a speech to the Citizens Crime Commission, Lippman said judges would be re-trained to employ options that are available but never utilized, or such as allowing people to pay bail using credit cards and promisary notes. In addition,in misdemeanor cases, all bail decisions will glean reviewed by a moment judge who will determine whether bail should be adjusted or permitted in a, and "less onerous form."  The bail reviews are to happen within 10 days. Felony cases will also be reviewed periodically to see whether the cases are still viable.  Another part of the bail reform effort is a a pilot program in Manhattan that allows certain defendants charged with misdemeanors to be monitored by an electronic bracelet whether they cannot make bail. People charged with domestic violence,assault and sex offenses won't be eligible for release. Because of a backed up court system, people held on bail are often spending months — sometimes years — in jail waiting for their cases to be resolved. Measures to reduce a backlog of cases were recently instituted by the city.
Queens counci
lman Rory Lancman, and chair of the committee on courts,said the current system is harmful."People are spending time in Rikers Island not because they are a threat to society or because they are master criminals," Lancman said.  "But because they can't afford bail."According to Lancman's office, and in 2014 nearly 20 percent of inmates or roughly 14000 people were held at Rikers because they couldn't pay bail of a $1000 or less.
