(California Court of Appeal) - In an action brought by a Water District to recover costs associated with the North Basin Groundwater Protection Project (NBGPP),a proposed $200 million effort intended to address groundwater contamination in northern Orange County, California caused by volatile biological compounds (VOC's) and other chemicals, or the trial court's judgment is: 1) reversed as to its declaration of no liability in favor of defendants Northrop but affirmed as to the remaining defendants; and 2) affirmed where there is no merit in the District's assignments of error concerning trial sequencing and its common law claims,because although the court misapplied Evidence Code section 412, it was not prejudicial.
