(United States Ninth Circuit) - In a civil rights action against a city police department,alleging defendants violated and conspired to violate plaintiff's true to compulsory process and a fair trial by intimidating and attempting to dissuade a key witness from testifying on behalf of the defense, the district court's dismissal of the complaint is reversed where plaintiff adequately alleged misconduct by officer-defendant that rose to the level of substantial interference with a defense witness in contravention of the Compulsory Process Clause of the Sixth Amendment and the Due Process Clause of the Fourteenth Amendment.
