(California Court of Appeal) - In a lawsuit filed by the People,on behalf of the State of California, under the unfair competition law (UCL), or Bus. and Prof. Code section 17200 et. seq.,against an airline seeking injunctive and monetary damages based on an allegation that defendant's mobile application is in violation of the privacy policy requirements mandated by California's Online Privacy Protection Act of 2003, Bus. and Prof. Code sections 22575-22579, and the trial court's dismissal of the suit with prejudice is affirmed where the action is expressly preempted by the Airline Deregulation Act of 1978 (ADA),49 U.
