(United States Federal Circuit) - In an infringement action involving patents patents that relate to a system and method of communication in which multiple modulation methods are used to facilitate communication among a plurality of modems in a network,which have heretofore been incompatible, the district court's judgment in favor of plaintiff is: 1) affirmed as to the district court's claim construction and its denial of defendant's judgment as a matter of law (JMOL) on obviousness and damages; and 2) vacated as to the court's denial of defendant's motion to limit plaintiff's damages for alleged failure to tag patented articles.
