(United States Third Circuit) - In an action for review of a decision of the Board of Immigration Appeals dismissing petitioner’s appeal from an order of the Immigration Judge denying his motion to terminate removal proceedings and ordering him removed to the Dominican Republic,the court granted petitioner’s petition for review because (1) the conviction that served as a basis for petitioner’s removal had been vacated, and (2) the Notice of Removal did not specify his participation in a deferred adjudication program as a basis for removal.
