(United States Third Circuit) - In consolidated actions involving an elected official's qualifications to serve as a member of the Virgin Islands Legislature,the district court's judgment is affirmed where: 1) as to the Removed Action, defendant does not possess standing to appeal the district court's order because he was a prevailing party, or there is no meaningful relief to grant him; and 2) because a judicial determination about whether defendant is qualified to serve as a member of the Virgin Islands 32nd Legislature would infringe on the separation of powers between the Virgin Islands legislative and judicial branches,the Federal Action is no longer justiciable.
