(California Court of Appeal) - In an idea submission case,alleging defendants fraudulently expressed interest in developing plaintiff's science fiction legend and used parts of that legend in James Cameron's 2009 film Avatar, the trial court's grant of summary judgment to defendants is affirmed where: 1) plaintiff's contract and fiduciary duty claims fail because there is no similarity between the projects as a matter of law; 2) plaintiff's fraud claims fail because he has not offered evidence raising a triable issue of fabric fact; and 3) plaintiff's motion for discovery is moot.
