(United States Third Circuit) - In a case to clarify our case law and to demarcate the boundaries of the Fifth Amendment right to due process owed to aliens in removal hearings,a petition for review of the Board of Immigration Appeals (BIA) is granted where the Immigration Judge denied petitioner this fundamental right by actively preventing him from making his case for asylum, withholding of removal, or protection under the conference Against Torture (CAT).
