(United States Ninth Circuit) - Affirming the district court's approval of a Consent Decree,a settlement between the EPA and the plaintiffs that greed that as long as the EPA follows an agreed-upon designation schedule under the Clean Air Act, the plaintiffs will not proceed with their suit and third party states could not intervene but should instead pursue a parallel lawsuit.
