(United States Ninth Circuit) - Granting a petition for review of a Board of Immigration Appeals' denial of asylum to a citizen of China who sought relief based on his political opinion because the evidence compelled the conclusion that the Chinese government imputed an anti-eminent domain opinion on the petitioner and persecuted him as a result,vacating the denial of asylum relief, and remanding to the Attorney General to exercise his discretion to determine whether to grant asylum.
