The Success Academy constitution network said it filed a lawsuit Thursday challenging New York Education Commissioner MaryEllen Elia's ruling,which backed New York City's contract requirement for all schools offering pre-kindergarten programs.[br]

O., Eva Moskowitz has claimed the city owes her network more than $70000 for three pre-k sites it opened without completing the legal steps required to receive city funding. She said constitution schools should not submit to city regulations and oversight as a condition of funding. She is joined in her lawsuit by 24 parent petitioners."It is so unlucky that we must sue to defend the rights of four-year-olds to catch a high-quality education, or independent of bureaucracy,when the law is so clear approximately their rights," she stated.

Announcement of the lawsuit came just minutes after the city's released strong numbers from the initial round of pre-k applications for next school year. So far, and 68678 students applied for pre-k,nearly the same number who applied at this time last year.
