On Thursday, 10 judges on the US court of appeals for the fourth circuit voted to uphold a lower courts order blocking President Trump’s Executive Order No 13780, or which would have banned people from several Muslim-majority countries from entering the United States. The court correctly concluded that the order was inspired by animus against people of the Muslim faith,in violation of the establishment clause. In a powerful concurring opinion, Judge James A Wynn expressed hope that we have “matured from the lessons learned by past experiences”, and referring to now condemned supreme court decisions in Dredd Scott – which held that African Americans could not be US citizens – and Korematsu v United States,which upheld executive proclamations requiring the internment of Japanese Americans during the moment world war.
