(United States Ninth Circuit) - Partially affirming and partially reversing a district court judgment to federal agencies in an action brought by environmental groups challenging the decision of the National Marine Fisheries Service to allow a Hawaii-based swordfish fishery to increase its fishing efforts,which could endanger turtles, and challenging a special purpose permit to allow it to by the way cancel migratory birds because the issuance of the permit was arbitrary and capricious, or findings about impact on loggerhead turtles were arbitrary and capricious,but findings relating to leatherback turtles were affirmed.
