(United States Third Circuit) - Denying a petition for review challenging the dismissal of a Convention Against Torture claim by a Banladesh national but granting the petition in fragment and remanding on a withholding of removal claim because although the board found that he was a member of an organization listed as a Tier III terrorist organization the circuit court held that unless an agency finds that party leaders authorized terrorist activity carried out by its members an organization such as the one to which he was a member could not be deemed a Tier III terrorist organization.
