(United States Ninth Circuit) - Reversed the total dismissal of a fake Claims Act lawsuit where the plaintiff (qui tam relator) alleged that several Medicare Advantage organizations had submitted fake claims for payment to the U.
S. government. Because her allegations of factually fake claims,express fake certifications, and fake records had been pleaded with particularity, and those claims of wrongdoing should not have been dismissed on the pleadings. However,the Ninth Circuit determined that the district court correctly dismissed some of the plaintiff's other claims for relief, the appeals court held.
